Elim Pharmacy General Merchants (“we”, “us”) respects your privacy. This policy explains how we collect and use your personal data when you use elimpharmacy.com.ng, visit our branches or contact us. We follow the Nigeria Data Protection Act 2023 (NDPA) and guidance from the Nigeria Data Protection Commission (NDPC). We are the data controller for your data.
1. Data we collect
- Contact and account details: name, phone number, email, delivery address and login details.
- Order details: what you buy, order history and delivery or pickup choice.
- Health information: prescriptions you upload, medicines you buy, and details you or your prescriber give us (such as the prescriber’s name, hospital and MDCN number). Health information is sensitive personal data under the NDPA, and we take extra care with it.
- Payment details: payments are handled by Paystack. We receive a confirmation and limited details (such as the last four digits of a card), not your full card number.
- Technical data: IP address, device and browser type, and pages viewed, collected through cookies and similar tools.
- Messages: what you send us through forms, email, phone or WhatsApp.
2. Why we use your data, and our legal basis
- To process, check and deliver your orders: performance of a contract.
- To check prescriptions and give safe pharmaceutical care: your explicit consent (given when you upload a prescription or place a medicine order) and our legal obligations as a pharmacy.
- To keep records required by the Pharmacy Council of Nigeria, NAFDAC and tax law: legal obligation.
- To prevent fraud and keep the Website secure: legitimate interests.
- To send offers and health tips: consent only. You can opt out at any time.
3. Who we share it with
We do not sell your data. We share it only when needed with:
- our pharmacists and staff who need it to serve you;
- Paystack, for payments;
- delivery riders or couriers (name, phone and address only);
- our website hosting and email providers, who must keep it secure;
- your prescriber, to confirm a prescription; and
- regulators, law enforcement or courts, when the law requires it.
Some of these providers may store data outside Nigeria. When that happens, we make sure there are adequate safeguards as the NDPA requires.
4. How long we keep it
We keep prescription and dispensing records for as long as pharmacy regulations and tax law require. Other account and order data is kept while your account is active and for up to 6 years after your last order. Marketing data is deleted when you opt out. After that, we delete or anonymise your data.
5. How we protect it
We use encrypted (HTTPS) connections, access controls, and staff confidentiality duties. Only authorised staff can see prescriptions. No system is perfectly secure, so please keep your password private.
6. Your rights
Under the NDPA you have the right to:
- be told how we use your data and get a copy of it;
- ask us to correct wrong data;
- ask us to delete your data, where we are not required by law to keep it;
- object to or restrict some uses, including marketing;
- withdraw consent at any time (this does not affect past use); and
- receive your data in a common format.
To use these rights, email info@elimpharmacy.com.ng. We will reply within 30 days. If you are not happy with our reply, you can complain to the Nigeria Data Protection Commission (ndpc.gov.ng).
7. Cookies
We use cookies that the Website needs to work (for example, your cart and login), and may use analytics cookies to understand how the Website is used. You can block or delete cookies in your browser, but some parts of the Website may then stop working.
8. Children
The Website is not meant for people under 18. A parent or guardian should place orders for children.
9. Changes
We may update this policy. The date at the top shows the latest version.
